GENERAL TERMS AND CONDITIONS

These general terms and conditions of sale (GTC) apply to all sales of goods offered by MUGI (formerly known as Thirstycat.ch) . By placing an order on MUGI's e-commerce platform, you accept the conditions below without any modification and in their entirety.

These conditions have been translated into English. In case of any discrepancies between the languages, the French version shall prevail.

  1. The customer expressly waives their own general terms and conditions of sale, even if they have been established subsequent to these general terms and conditions of sale. To be valid, any derogation must be expressly agreed upon in writing in advance.

  2. We sell our products through our e-commerce platform, which is accessible at the following address:

    MUGI cannot be held responsible for items purchased on other platforms or at addresses other than those mentioned in this document.

  3. We do not sell our products to individuals under the age of 16 (art. 50, para. 1 LADB).

  4. The prices listed in this catalog are stated in Swiss Francs and are net amounts, which include all applicable taxes within Switzerland. Please note that any additional taxes or charges outside of Switzerland are excluded and not included in these prices.

  5. The following payment methods are available:
    1. Bank transfer (e-banking)
    2. Debit & Credit cards (VISA, MasterCard)

  6. By placing an order on MUGI.beer, the customer agrees to the purchase of the selected products, as all confirmed orders are considered binding. Due to the nature of beer and sake as products from the food segment, items ordered cannot be exchanged or returned. 
    If a customer wishes to cancel an order after payment but prior to shipping or pickup, they must submit a cancellation request by replying to the order confirmation email. In such cases, a cancellation fee of 5% of the order amount, with a minimum of CHF 5.- , will be charged to cover payment acquirer and third-party costs.

  7. The shipment of available items is carried out by the selected third-party carrier  within a period of approximately 1 to 6 days.

    A contribution from your side is requested only once per order.
    Shipping fees within Switzerland are waived for orders totaling over CHF 80.
    We do not ship outside of Switzerland due to the high costs and risks associated with international deliveries. However, if you still wish to proceed with an international shipment, please contact us directly for a personalized quote and further assistance.

    MUGI does not deliver packages to P.O. boxes and does not deliver any goods to minors or individuals under guardianship, except with written authorization from parents or the legal guardian.

  8. Our commitment to delivery is rendered void if our own suppliers fail to meet supply deadlines, except in cases where this unavailability is not attributable to MUGI.

    If a product becomes unavailable, we will notify you as soon as possible. Detailed delivery times can be found on the respective product pages. MUGI is not liable for transportation issues. If a delivery or service deadline cannot be met due to force majeure, labor strikes, unforeseeable obstacles, or other circumstances beyond MUGI's control, the deadline will be extended accordingly.

    If the inability to deliver is due to supplier incapacity, both MUGI and the customer have the right to withdraw from the contract if the agreed delivery date is exceeded by more than two months. Claims for damages arising from delays, impossibility, or non-fulfillment, including those that have occurred before the contract withdrawal, are excluded, unless a legal representative of MUGI has acted with intent or gross negligence. Additionally, you will receive an email notification when your order is dispatched.

  9. The transfer of risk occurs when the ordered goods are handed over to the carrier. MUGI bears no responsibility for any damage or loss that may occur during transit. If there is visible damage to the package, the customer must promptly report it to the responsible carrier and inform MUGI accordingly. The shipment should be kept in the same condition as when the damage was discovered.

  10. Orders placed on the MUGI online shop are considered binding. Due to beer being a product from the food category, ordered beers cannot be exchanged or returned, except in cases of incorrect deliveries or beers with production defects.

    In order to exercise the right of withdrawal, the following steps are necessary:

    Upon receiving the shipment, promptly check its accuracy and condition.
    Immediately report any discrepancies by sending an email to info@mugi.beer.
    Please note that complaints received at a later time cannot be taken into consideration.

  11. All personal data will be treated as confidential. The information necessary for order processing will be subject to computer processing and may be shared with affiliated companies for the purpose of order management.

  12. Swiss law shall apply. Any dispute shall be submitted to the District Court of La Côte, in Nyon.
